Fuzzy laws come into play in the HP Pretexting Case
Despite the California Public Prosecutor-General say he had enough evidence for the prosecution against the man inside and outside Hewlett-Packard, a criminal organization, perhaps difficult to follow, legal specialists say.
The California prosecutors are still gathering evidence and records no booking fees. But they think people, Hewlett-Packard or a string of subcontractors used fraudulent means to access telephone records to injure some or all of four state statutes, Tom Dresslar, a spokesman for the prosecutor General Bill Lockyer said Monday.
These laws are used by people who believe in the false prosecutors to someone else to obtain private phone records, a practice known as Pretexting. Hewlett-Packard has acknowledged that the method was to examine the messages from its trailing edge. Records of Directors, employees and journalists were obtained.
Two of the laws of the State intends to cover the costs of crime unauthorized access to computer data, one of those also prohibits the use of these data for fraud. To call the lawyers, laws “Wobbler”, as it can for a crime or misdemeanors can lead to a penalty of up to three years imprisonment and a fine of $ 10000.
Another potentially applicable law includes access to personal information, including Social Security numbers. The Attorney General is seeking a fourth law, which makes it a crime to gain unauthorized access to customer data from a utility.
“We believe that laws were broken, we first try to discover, it broke,” said Dresslar.Mr. Dresslar said the state believes that laws which are not only the person holding the Pretexting, but others, has been authorized, financed or knew and let him go. “You should not the person who was sitting on the keyboard and reality Pretexting,” he said.
